Royalty/Class Action Lawsuits – Lawyers in Holland & Hart’s Cheyenne office obtained a favorable class action settlement of Wyoming Royalty Payment Act reporting claims in Wyoming State Court for major oil and gas producer. Developed future reporting methodology to prevent additional litigation and allow accounting certainty with streamlined royalty reporting.
Environmental Law – We successfully defended oil and gas operator’s Clean Water Act permit for coalbed methane discharges before the Wyoming Environmental Quality Council. The result allowed completion of a water treatment plant essential to continued gas production and was one of the first and only successful defenses against a landowner appeal of a coalbed methane produced water discharge permit before the Environmental Quality Council.
Surface Use Agreements & Litigation – We litigated the first case brought under Wyoming’s Split Estate Act for surface damages over federal gas development. After addressing hotly contested evidentiary and punitive damages issues, the case resulted in mediated settlement favorable to oil and gas company on the eve of trial. We have also advised oil and gas companies on a wide variety of Wyoming real property issues, including drafting easements and rights of way.
Transactions – We have acted as lead counsel in acquisitions of oil and gas leases and related interests throughout Wyoming.
Administrative Law – We regularly appear before and work with Wyoming state and federal agencies on well permitting, environmental, tax and royalty issues. We have also successfully challenged agency decisions in state and federal courts.
